A cannabis company has launched legal action against the town of Pelham over a one-year moratorium on building new cannabis facilities or expanding existing ones.
Town council unanimously passed an interim control bylaw restricting any cannabis-related land uses for one year back in October.
The bylaw could be extended for another year once it expires on October 15th.
A release from Leviathan Cannabis Group says the litigation was filed through the Ontario Superior Court of Justice, alleging the bylaw violates the company's right to develop its property on Foss Road.
Officials for the company say the decision follows an 'exhaustive process' where they tried to work with town officials to get approval for an exemption application.
