In a move that has stunned his victim's family, a Hamilton man convicted of murder is being released on bail while he appeals his conviction.
Robert Badgerow, is the only person in Canada to be tried four times for the same murder.
Last December he was found guilty of raping and murdering Diane Werendowicz in 1981.
Badgerow has always maintained the two had consensual sex after meeting at a Stoney Creek bar and someone else killed her as she left to walk home.
He is expected to be released today, under terms of his bail conditions will reside with his mother in Binbrook.
