An effort to prevent former Ontario premier Dalton McGuinty from taking the stand in a lawsuit filed by a group of horse breeders has failed.
The group of standard horse breeders has filed a $65 million dollar lawsuit against the province and OLG for cancelling the slot machine revenue sharing program with the horse racing industry in 2012.
The breeders argue they were dropped from the program without notice.
Yesterday a Divisional Court judge dismissed an attempt by the OLG and province to stop McGuinty and his former finance minister Dwight Duncan from taking the stand.
Several racetracks in Ontario lost their racinos including Fort Erie when the province ended the program.
