A man from Beamsville is suing the Niagara Regional Police for more than $5.1 million, saying he was racially profiled and illegally searched after calling 911.
According to documents obtained by the St. Catharines Standard Marvin Mitchell claims he called 911 during an argument with his fiancee, but didn't speak with a dispatcher.
When dispatch called back Mitchell told them no one was in danger, but when prompted he said he had registered guns in the home.
His phone then died during the call.
The legal documents go on to describe a subsequent call from a staff sergeant and three officers in SWAT gear waiting outside the home who placed Mitchell in cuffs.
Mitchell claims he was never cautioned nor read his rights, and officers searched both him and his home without a warrant.
After an hour, Mitchell says he was released and officers admitted they had made a 'mistake in judgment.'
