The Ford government is asking Ontario Superior Court to quash a legal challenge of its decision to repeal the updated sex-ed curriculum brought in by the Liberals.
In a document filed in court, government lawyers argue the education minister has the responsibility to set policy in Ontario's public schools, not the courts or the groups challenging the return to the previous curriculum developed in the late 1990's.
The Canadian Civil Liberties Association and the Elementary Teachers' Federation of Ontario have argued the move is unconstitutional because it puts students at risk.
But the Progressive Conservative government argues that if the curriculum prior to 2015 didn't infringe the Charter of Rights, it can't be unconstitutional to return to it.
