Ontario's top court has ruled Fort Erie was wrong to issue a trespass order banning an obnoxious, but non-violent protester from town property.
The court of appeal says the order violated Fred Bracken's right to express his political views and a lower court should have tossed it out as unconstitutional.
The court added Bracken may be aggressive in questioning and can be intimidating, but there is no evidence that he was violent or threatened violence.
Bracken was incensed that town council decided to allow a medical-marijuana facility across the street from his home and was issued the trespass order after he paced up and down outside
Town Hall in 2014 yelling ``Kill the bill!'' and refused a police order to go away.
