Lawyers for the province say if the Ontario Court of Appeal rules in their favour, the Ford government will not use the not withstanding clause to push through cuts to Toronto city council.
The province making its case yesterday, asking the three judges to grant a stay of a lower court ruling that found the province's plan to cut council nearly in half is unconstitutional because the call was made during an election period.
A stay would allow the province to move head with its plan to cut council from 47 to 25 seats.
The ruling is expected later this morning.
