The province's Special Investigation Unit, had cleared Niagara police in a September 1st, 2016 incident that saw a 24 year old man sustain injuries.
The SIU says two officers were attempting to arrest a suspect found in a truck on Ferry Street on an assault causing bodily harm charge.
During the arrest, the suspect attempted to flee the scene.
Officers tackled the man to the ground and a struggle ensued between the suspect and the officers.
The SIU says the suspect refused to show his hands, police fearing he may have had a firearm, struck him in the face and rib area as well as the thigh to gain compliance.
The man was not struck after he was handcuffed.
Following his arrest he was taken to hospital and treated for a broken nose.
The Acting Director of the SIU says as a result of the investigation he determined there was no reasonable grounds to lay criminal charges.
